*Liability Release Form for Castaway Beach Camp
In consideration of being allowed to participate in any of Castaway Beach Camp programs and/or related activities, I acknowledge and agree to the following terms:
1. Assumption of Risk:
I understand that the activities involved in this program, including surfing and water-based activities, carry significant risks, including but not limited to permanent paralysis, injury, or death. While rules, equipment, and personal discipline may reduce these risks, the possibility of serious injury still exists.
2. Acknowledgment of Risks:
I acknowledge that surfing and other open-water activities can be dangerous and involve both known and unknown risks. I accept and assume these risks, even if they arise from the negligence of the releasees or others, and I assume full responsibility for my participation.
3. Release of Liability:
I voluntarily release, discharge, and hold harmless Castaway Beach Camp, Okaloosa County Beaches, the City of Fort Walton Beach, the State of Florida, Holiday Inn Resort FWB, Hilton Garden Inn Ft. Walton Beach, and any associated entities, along with their employees, officers, agents, and representatives (collectively referred to as "Castaway Beach Camp"), from any and all claims, demands, or causes of action arising from my participation in the surf lesson or related activities, including any injuries, illnesses, or damages resulting from negligence or other acts by the releasees. If I observe any hazards during my participation, I agree to remove myself immediately and notify an official.
4. Waiver of Legal Action:
In consideration of receiving surfing instruction and participating in the lesson, I agree not to make any claim, sue, or hold responsible Castaway Beach Camp, Okaloosa County Beaches, the City of Fort Walton Beach, Holiday Inn Resort FWB, Hilton Garden Inn Ft. Walton Beach,, the State of Florida, or their representatives for any injury, damage, illness, or death related to my participation. This includes releasing the school from liability for any act or omission, except in cases of gross negligence, related to emergency or medical services.
5. Promotional Use of Images:
I understand and agree that Castaway Beach Camp may take photographs or video footage during my lesson for promotional and commercial purposes. I consent to the use of my name, image, and likeness in any media (now known or hereafter developed) for such purposes without compensation. I also understand that Flagler Surf School may or may not choose to post these images on social media platforms or other promotional materials.
6. Equipment Responsibility:
I agree to replace or compensate for any equipment damaged due to my negligence during the lesson or program.
7. Release and Indemnification:
I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release, indemnify, and hold harmless Castaway Beach Camp, its officers, officials, agents, employees, sponsors, advertisers, and any owners or lessors of the premises used for the activity (“Releasees”), from any and all injury, disability, death, or damage to personal property, whether arising from negligence or otherwise, to the fullest extent permitted by law.
8. Parental Consent (if applicable):
As the parent or legal guardian of the participant, I hereby consent to the above terms and agree to release and indemnify Castaway Beach Camp from any and all liabilities related to my minor child’s participation in these activities, including those arising from negligence.
I HAVE READ AND FULLY UNDERSTAND THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT. I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
I acknowledge and understand that surfing can be a dangerous activity and accept full liability *
I acknowledge and agree to the terms of the *Liability release form below. By participating in any physical activity with Castaway Beach Camp. I release the Camp from liability for any accidental injury or illness my son or daughter may incur. I assume all associated risks and consent for my children to participate. I also agree to disclose any physical limitations, disabilities, ailments, or impairments that may affect my child's ability to participate in this program.
